DEBATE: UN RESOLUTION IDEA FOR REFUGEES

How the debate works:

I have made a proposal for a UN resolution that shall be debated on. In order to participate write in the comments your argument explaining whether or not it could work. Make sure to list out all flaws.

Purpose: To encourage MEDCs (more economically developed countries) to take a percentage of refugees every year 

What the resolution shall entail:

  • the percentage of refugees meant to be taken in varies on the member states’ GDP
  • the states must provide refugees with suitable resources in order to live
  • UNHCR frequent checks to make sure no human rights violations are committed in said country
  • an established vetting system that can be altered to a certain extent, used by all member nations who adopt the resolution
  • the distribution of refugees from LEDCs(low economically developed countries) to MEDCs

THE UNHCR.

What is the UNHCR?

The United Nations High Commission for Refugees or UNHCR is a program established to aid refugees in a variety of ways. The agency was established during the year 1950 and continues to support and protect them.

 

Purposes:

  • find solutions to problems related to refugees
  • enforces people’s right to seek both refuge and asylum in other states
  • give humanitarian assistance
  • obtains a database with information on refugees

 

OPINION:

 The UN Refugee Agency is mostly known for providing humanitarian aid for refugees which is beneficial to a certain extent. However, many issues remain which may possibly be the reason why the refugee issue still exists. Some of them being the great disparity between the countries that accept refugees and those that do not (it is said that ’10 countries host half of the world’s refugees), mostly low economically developed countries do and it’s very difficult to maintain, and finally the conflicts that arise that cause refugees to flee remain unresolved. The UNHCR nonetheless is still making a considerable effort to provide aid for refugees, and it is time we find ways to help as well.

THE INTERNATIONAL LAW ASSOCIATION BRIEF.

An association which devotes its time and efforts to researching and studying international law. It is a non-profit which has its headquarters in Britain. Currently, there are committees in a variety of topics in both private and public international law. The association produces its findings and reports and shares them among members. Around 75 conferences have been initiated in the past and there will be more to come in the nearby future.

THE AFRICAN COURT ON HUMAN & PEOPLES’ RIGHTS.

THE AFRICAN COURT ON HUMAN & PEOPLES’ RIGHTS.

What is it?
This court was made to enforce and ensure the decisions or functions of the African Commission on Human Rights and People. However, before this court was established, a different court named the Court of Justice of the African Union was meant to be created, but it never was established, due to the creation of the African Court on Human and Peoples’ Rights.

 

Purposes & Roles:

  • guarantees and protects human rights in Africa
  • increase the relationship between the African Commission and the Court
  • Cooperate with certain judicial bodies in order to promote the protection human rights
  • ensure the decisions of the African Commission on Human Rights and People

 

OPINION

The Court of Justice is necessary for protecting and ensuring the human rights of those in Africa. Though the Court of Justice of the African Union was not established, the African Court on Human and Peoples’ Rights is, in fact, both an adequate and satisfactory replacement as it thoroughly focuses on ensuring the human rights of people in Africa. The establishment of this court shows both the recognition and acknowledgment of human rights which is progress for human rights not only in Africa but everywhere.

THE EUROPEAN COURT OF JUSTICE.

What is it?
This court is essentially the most important or most significant court in the European Union. It is highlighted that the European Court of Justice deals with EU or union law rather than national or domestic law. This court was established during the year 1952 and is currently located in Luxembourg.

 

Purposes & Roles:

  • analyzes European Union law
  • ensures that EU states abide by the union’s laws
  • make sure that the EU continues to take action
  • nullify certain acts

 

OPINION: is it necessary, effective, beneficial?

The European Court of Justice is both effective and beneficial for all member states and citizens in the EU. This court is imperative as it resolves disputes between not only member states but citizens and EU institutions. For instance, if citizens believe that EU law has been infringed they have the ability to have the Court take action. Clearly, the court is seen as the foundation for EU law and has a huge effect on how the EU works. I definitely believe that without this court, the EU would definitely not be as effective or efficient today.
